The use of services provided by MITCE (Unrestricted Proxy Network), operated by LibertyLink Technologies Company, a registered entity in Singapore (hereafter referred to as "MITCE"), is subject to the following Terms and Conditions.


Party Definitions and Introductory Terms
  1. MITCE is the publisher and operator of www.mitce.com (the "Site") whereby MITCE makes certain proxy services (the "Services") available. For purposes of this Agreement, when "Site" or "Services" are referenced, such reference includes all hardware, software, and network resources necessary to provide said Site and/or Services.
  2. You, the User - As our user and the consumer of the Site or Services, this Agreement will refer to you through any second-person pronouns, such as "You," "Your," "Yours," etc.

Acceptance of Terms

By accessing and using our Services, you agree to be bound by these Terms and Conditions (the "Agreement"). If you do not agree with any part of this Agreement, you must not use our Services.

Modifications to Terms

We reserve the right to modify or replace these Terms at any time without prior notice. It is your responsibility to review this Agreement periodically for changes. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

Eligibility

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you have the legal capacity to enter into this Agreement.

Use of Services

You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations in Singapore, the European Union, and any other jurisdiction relevant to your use.

Prohibited Activities

You are expressly prohibited from engaging in the following activities while using our Services:

  • Engaging in any activity that violates any local, state, national, or international law or regulation.
  • Transmitting any material that is unlawful, harmful, threatening, defamatory, obscene, harassing, or otherwise objectionable.
  • Infringing upon or violating our intellectual property rights or the intellectual property rights of others.
  • Distributing viruses, malware, or any other harmful code that may damage or interfere with the Services or the interests of other users.
  • Attempting to gain unauthorized access to our network, servers, or user accounts.
  • Engaging in any form of network abuse, including but not limited to excessive usage that negatively impacts other users or our network infrastructure.
  • Conducting any form of fraudulent activity, including phishing, spamming, or any other activity designed to defraud individuals or entities.
  • Using the Services for any form of surveillance or unauthorized data collection.

Network Proxy Abuse Policy

We are committed to providing a reliable and secure proxy network for all users. To maintain the integrity of our Services, we have established the following policies regarding network proxy abuse:

Definition of Abuse: The following actions constitute abuse and are strictly prohibited:

  • Using the Services to engage in illegal activities, including but not limited to hacking, cyber-attacks, or distributing illegal content.
  • Engaging in activities that compromise the security or functionality of any network, system, or device.
  • Overloading our network through excessive bandwidth usage or creating abnormal traffic patterns.
  • Attempting to bypass any security measures implemented by websites, servers, or networks.
  • Sharing your account credentials with others or allowing unauthorized users to access the Services.
  • Reselling or redistributing our Services without explicit written permission.

Account Suspension Due to Abuse

If we determine, at our sole discretion, that you have engaged in any form of abuse or prohibited activities, we reserve the right to suspend your account immediately without prior notice. In such cases:

  • Your access to the Services will be terminated without prior notification.
  • You are required to contact us to address and resolve the issue.
  • We will not proactively contact any customers whose accounts have been suspended due to abuse.

We are not responsible for any loss or inconvenience you may experience due to the suspension of your account under these circumstances. It is your responsibility to ensure compliance with these Terms to avoid suspension.

Commitment to Anonymity

No-Logs Policy

We maintain a strict No-Logs Policy. This means we do not collect or store any logs of your online activities, including browsing history, traffic destination, data content, or DNS queries. No one can obtain your IP addresses used on the MITCE official website. Your privacy is of utmost importance to us, and this policy complies with EU privacy laws. Everyone has the right to browse anonymously.

Refusal to Disclose Information

We are committed to protecting our customers' information and will refuse to provide any customer data to third parties unless required by law. We will challenge any request that we believe is invalid under applicable laws.

Privacy and Data Protection

Account Security

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your devices. You agree to accept responsibility for all activities that occur under your account or password.

Payment and Billing Terms

All fees for the Services are due in advance and are non-refundable except as specified in our Refund Policy. We accept various payment methods, including credit cards and virtual currencies. By providing a payment method, you represent that you are authorized to use the payment method and authorize us to charge the full amount due for your subscription.

Refund Policy

At MITCE, customer satisfaction is important to us. However, due to the nature of our Services, all subscription packages are generally non-refundable. Exceptions may be made under the following conditions:

  1. Eligibility for Refunds:
    • Within 24 Hours of Purchase: If you are unsatisfied with the Services and request a refund within 24 hours of your initial purchase, and your data transmission usage is less than 10% of the allotted amount, we may consider issuing a refund at our sole discretion.
    • Service Level Reduction Due to Force Majeure: If there is a significant reduction in service quality or availability due to force majeure events (such as natural disasters, acts of terrorism, or other events beyond our reasonable control), we may increase the possibility of issuing refunds.
  2. Non-Eligibility for Refunds:
    • Violation of Terms: If you have violated any terms of this Agreement, including but not limited to engaging in prohibited activities or abuse of the Services, you will not be eligible for a refund.
    • Previous Refund Requests: Each account is entitled to only one refund request. If you have previously received a refund from us, subsequent refund requests will be denied.
  3. Refund Process:
    • To request a refund, you must contact our customer support team within the specified time frame.
    • Refunds will be issued to the original payment method used during purchase. Processing times may vary depending on your financial institution.
  4. Non-Refundable Circumstances:
    • Refunds will not be issued for any charges incurred due to currency fluctuations, bank fees, or other charges beyond the subscription fee.
    • Refunds are not available for accounts terminated due to violations of our Terms and Conditions.
  5. Discretionary Rights:
    • All refund decisions are made at our sole discretion. We reserve the right to deny any refund request that does not meet the criteria outlined in this policy.

By purchasing our Services, you acknowledge and agree to this Refund Policy.

Third-Party Services and Content

Our Services may include or provide access to third-party services and content. We do not control, endorse, or assume responsibility for any third-party services or content. Your use of third-party services and content is at your own risk and subject to the terms and conditions of those third parties.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under this Agreement due to events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, technical failures, or governmental actions.

Assignment

You may not assign or transfer your rights or obligations under this Agreement without our prior written consent. We may assign or transfer our rights and obligations under this Agreement without restriction.

Waiver

Our failure to enforce any right or provision of this Agreement will not be considered a waiver of those rights. Any waiver of any provision of this Agreement will be effective only if in writing and signed by an authorized representative of MITCE.

Feedback and Communication

We welcome and encourage you to provide feedback, comments, and suggestions for improvements to the Services ("Feedback"). You may submit Feedback by emailing us at support@mitce.com. By submitting Feedback, you grant us a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable, perpetual license to use and publish those ideas and materials for any purpose, without compensation to you.

Language

The governing language of this Agreement is English. All communications and notices to be made or given pursuant to this Agreement must be in the English language.

Intellectual Property Rights

All content included on the Site and available through the Services, such as text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, and software, is the property of MITCE or its content suppliers and is protected by international copyright laws.

Disclaimers and Limitation of Liability

The Services are provided on an "as is" and "as available" basis. MITCE makes no representations or warranties of any kind, express or implied, regarding the operation of the Services or the information, content, or materials included therein.

To the fullest extent permissible by applicable law, MITCE disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. MITCE will not be liable for any damages of any kind arising from the use of the Services, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Indemnification

You agree to indemnify, defend, and hold harmless MITCE, its affiliates, officers, directors, employees, agents, and third parties from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services or violation of this Agreement.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Singapore and the European Union, without regard to their conflict of law provisions.

Dispute Resolution

Any disputes arising out of or relating to this Agreement shall be resolved through amicable negotiations. If such disputes cannot be resolved, they shall be submitted to the exclusive jurisdiction of the courts of Singapore.

Termination

We reserve the right to terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Severability

If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Entire Agreement

This Agreement constitutes the entire agreement between you and MITCE regarding the use of the Services and supersedes any prior agreements between us.

PLEASE READ THE ABOVE PROXY SERVICES TERMS AND CONDITIONS CAREFULLY. BY USING MITCE SERVICES, YOU AGREE TO BE BOUND BY ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE DO NOT USE OUR SERVICES.
